Hi, I’m Beth with TB Properties Buys Land. Today I’m going to answer a question that was posed to us when it comes to selling and closing on your vacant land. The question that was asked of us was whether as a seller, your spouse has to sign for the sale of the land. It’s a really good question, and there’s not just one answer for it.
The first thing to ask is, are both you and your spouse on the deed? If you both purchased the property together and both of your names are on the deed, then for sure, both of you will have to sign for the sale of your land. However, if you purchased the land before you were married or you purchased it only in your name and not in your spouse’s name, I don’t have a straight answer for you whether both of you will have to sign or not. It really depends on the state and the county in which your property is located and what their laws are. We have worked in some counties where it doesn’t matter that only one person’s name was on the deed, that it was purchased before they were married; the state required that both married persons had to sign for the sale of that property. In much the same way, we’ve also seen it in other areas where just the one person was able to sign for the sale of the property.
Now, if there are extenuating circumstances to be considered, such as your spouse is not able to sign and you’ve got power of attorney, that is another situation. So long as you have the power of attorney documentation and all is in order and you provide that to the title company, yes, you will be able to sign solely for the sale of your property. I wish I had an easy answer for you regarding this question. Do be prepared, based upon where you’re located, where both you and your spouse will have to sign for the sale of your property. Even so, if you have specific questions that’s always something that we can ask the title company and get back with you right away. That’s not hard to get you that answer.
